GST Margin Scheme

An ATO mechanism for calculating GST on property sales by a registered enterprise — GST is paid on the margin (sale price minus purchase price) rather than the full sale price. Common on subdivisions and developments. Confirm eligibility with an accountant.

The GST margin scheme is an ATO mechanism that changes how GST is calculated on a property sale — not whether GST applies. Under the ordinary rules a registered seller remits GST of one-eleventh of the full sale price. Under the margin scheme, GST is one-eleventh of the margin instead — broadly, the sale price minus what you paid for the property. On a deal with a large land or acquisition cost, that can be a materially smaller GST bill.

The scheme only matters once GST is in play at all, and for a flipper that is the threshold question. A one-off renovation of an established home is usually an input-taxed sale of existing residential premises with no GST. But if your activity looks like an enterprise — repeated projects, or a build that amounts to substantial renovations or creates new residential premises — the sale can become a taxable supply, and registration is generally required once turnover reaches the $75,000 threshold. That is the point at which the margin scheme becomes relevant.

The conditions that catch people

Eligibility is not automatic. The margin scheme is only available if the seller and buyer agree to use it in writing on or before settlement, and it cannot be used where the property was originally acquired as a fully taxable supply without the scheme. It is most commonly seen on subdivisions and new developments rather than cosmetic flips. Getting it wrong — assuming a sale is GST-free when it is taxable, or missing the written-agreement requirement — is an expensive mistake to unwind after the fact.
